Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before accessing or using the website and services operated by Blume Financial Inc., doing business as Paymints (“we”, “us”, or “our”).
1. Interpretation and Definitions

Words with capitalized initial letters have meanings defined under the following conditions. These definitions apply whether the terms appear in singular or plural form.

For the purposes of these Terms and Conditions:

Affiliate means any entity that controls, is controlled by, or is under common control with a party, where “control” means ownership of 50% or more of the shares or equity interests entitled to vote for directors or other managing authorities.

Company (referred to as “the Company”, “we”, “us”, or “our”) means Blume Financial Inc., doing business as Paymints.

2. Acknowledgment
These Terms establish the rules governing your access to and use of our Service and form a legally binding agreement between you and Blume Financial Inc., doing business as Paymints.
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must discontinue use of the Service.
You represent that you are at least 18 years of age. The Company does not knowingly permit individuals under 18 to use the Service.
Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, retain, and protect personal information. We encourage you to review our Privacy Policy before using the Service.
Our Services and Role
Paymints, a business name of Blume Financial Inc., provides payment processing solutions and related merchant services to businesses.
Depending on the products and services selected, Paymints may assist businesses with obtaining payment processing services, point-of-sale (“POS”) equipment and software, payment technology, merchant accounts, and related business solutions through third-party payment processors, acquiring institutions, technology providers, and other service providers.
Where payment processing or other services are provided by a third-party processor or financial institution, those services may be governed by a separate agreement between you and the applicable provider. The terms of that agreement will govern the applicable processing relationship and may supersede these Terms with respect to those specific services.
Paymints does not itself guarantee the approval, availability, pricing, processing capabilities, or continued availability of services provided by third-party processors, financial institutions, card networks, or technology providers.
Rate Reviews, Quotes, and Savings Estimates
Paymints may provide complimentary rate reviews, processing analyses, savings estimates, quotes, or other recommendations based on information you provide, including payment processing statements, transaction information, business details, or other relevant documentation.
Any rates, savings figures, projections, comparisons, or estimates provided by Paymints are intended for informational purposes only and represent good-faith estimates based on information and assumptions available at the time.
Actual pricing, fees, savings, processing terms, equipment costs, contract terms, and other charges may vary depending on factors including your business type, processing volume, transaction mix, card types, applicable interchange and assessment fees, processor approval, applicable regulatory requirements, and the final terms offered by the applicable payment processor or service provider.
No quote, estimate, comparison, or savings projection constitutes a binding offer or guarantee unless expressly confirmed in a written agreement executed by the applicable parties.
3. Promotions
Any contests, promotions, discounts, special offers, or other promotional programs made available through the Service may be subject to additional terms or eligibility requirements.
Where separate terms apply to a promotion, those terms will govern that promotion. If there is a conflict between these Terms and the specific promotional terms, the promotional terms will prevail solely with respect to that promotion.
4. Content and User Responsibilities
You are responsible for any Content you submit, upload, or otherwise make available through the Service, including ensuring that such Content is accurate, lawful, reliable, and appropriate.
By submitting Content to the Service, you grant Paymints a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, display, and distribute that Content only as reasonably necessary to operate, maintain, improve, and provide the Service.

We reserve the right, but do not assume an obligation, to remove or restrict access to Content that we reasonably believe violates these Terms, applicable law, or the rights of others.
5. Copyright and Intellectual Property
All intellectual property associated with the Service, including its original text, graphics, branding, logos, designs, features, functionality, software, and other materials, is owned by or licensed to Blume Financial Inc. and is protected by applicable intellectual property laws.
Nothing in these Terms grants you ownership of any intellectual property belonging to Paymints or its licensors.
If you believe that material available through our Website infringes your copyright or other intellectual property rights, please contact us at info@paymints.ca and provide sufficient information for us to investigate your concern.
6. Links to Third-Party Websites
Our Service may contain links to websites, platforms, products, or services operated by third parties.
These third-party resources are not owned or controlled by Paymints, and we are not responsible for their content, availability, privacy practices, security, terms, or policies.
Your use of third-party websites and services is at your own risk and may be subject to separate terms and privacy policies.
7. Termination
We reserve the right to suspend, restrict, or terminate your access to the Service at any time, with or without prior notice, where reasonably necessary, including if you violate these Terms, misuse the Service, engage in unlawful conduct, or create a risk to Paymints, our service providers, or other users.
Upon termination, any rights granted to you under these Terms relating to your use of the Service will immediately cease.
Any provisions that by their nature should survive termination, including intellectual property, disclaimers, limitations of liability, and dispute-related provisions, will remain in effect.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Blume Financial Inc., doing business as Paymints, and its directors, officers, employees, agents, affiliates, suppliers, and service providers will not be responsible for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your access to or use of the Service.
This includes, without limitation, loss of profits, revenue, business opportunities, data, goodwill, or anticipated savings.
To the fullest extent permitted by law, the total aggregate liability of Paymints arising from or relating to your use of the Service will not exceed the amount you paid directly to Paymints for the applicable Service during the twelve months preceding the event giving rise to the claim, or $100 CAD, whichever is greater.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
9. “AS IS” Disclaimer
The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
To the fullest extent permitted by law, Paymints makes no representations or warranties, express, implied, statutory, or otherwise, regarding the availability, accuracy, reliability, completeness, security, or uninterrupted operation of the Service.
We do not guarantee that:

Information provided through the Service will always be complete, accurate, or current.

Third-party services, processors, payment networks, or technology providers will remain available or operate without interruption.
10. Governing Law
These Terms are governed by and interpreted in accordance with the laws of the Province of British Columbia and the applicable laws of Canada, without regard to conflict-of-law principles.
11. Dispute Resolution
If you have a question, concern, or dispute relating to the Service or these Terms, you agree to first make a reasonable attempt to resolve the matter informally by contacting Paymints at info@paymints.ca.
We will make reasonable efforts to review and respond to your concern.
Nothing in this section prevents either party from pursuing any rights or remedies that cannot legally be waived or restricted under applicable law.
12. Severability and Waiver
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable by a court or other authority with appropriate jurisdiction, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable, where permitted by law.
The remaining provisions will continue in full force and effect.
A failure by Paymints to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision or any other provision in the future.
13. Changes to These Terms
We may revise or update these Terms from time to time.
When material changes are made, we may indicate the change by updating the “Last Updated” date at the beginning of these Terms or by providing additional notice where appropriate.
Your continued use of the Service following the posting of revised Terms constitutes your acceptance of the updated Terms to the extent permitted by applicable law.
